Packaging Requirements
Pipeline and Hazardous Materials Safety Administration · Oct 4, 1995 · Reference No. 95-0232
Interprets: 49 CFR § 173.24, 49 CFR § 173.24b, 49 CFR § 173.240
This is in response to your letter of July 21, 1995, and subsequent telephone conversation with Diane LaValle of my staff. You requested confirmation that Toxic solids, organic, n.o.s., 6.1, Packing Group III may be packaged in MacMillan Bloedel Bulk Packaging's SpaceKraft containers under the Hazardous Materials Regulations (HMR; 49 CFR parts 171-180). You describe the SpaceKraft containers as large corrugated boxes with a 220-330 gallon capacity. The side walls are made of 5/8 to 1 inch thick corrugated fiberboard and the box has a 3-ply poly liner.
As provided by § 173.240 the above named material may be packaged in sift-proof non-DOT specification closed bulk bins. Your bulk containers may be used provided they meet the general packaging requirements of §§ 173.24 and 173.24b which require the packaging to be strong (provide protection) and tight (securely closed to prevent leakage).
I hope this information is helpful.
A letter of interpretation applies the regulations to the facts the requester described. It isn’t a regulation and isn’t legal advice. The agency’s copy.
