Federal Register (Docket HM-189J; 58 FR 51530)
Pipeline and Hazardous Materials Safety Administration · Nov 19, 1993 · Reference No. 93-0100
Interprets: 49 CFR § 172.101
This responds to your October 8, 1993 letter concerning a final rule which was published October 1, 1993 in the Federal Register (Docket HM-189J; 58 FR 51530] amending the Hazardous Materials' Regulations (HMR; 49 CFR, Parts 171-180).
In the final rule, RSPA amended the 49 CFR 172.101 Hazardous Materials Table entry for "Lighters or Lighter refills (cigarettes) containing flammable gas" to show "(cigarettes) containing flammable gas" in italics. The effect of this amendment was to require only "Lighters" or "Lighter refills" to appear in the shipping description or on package markings. Due to a printing error, the descriptive phrase "(cigarettes) containing flammable gas" does not appear in italics in the amended description for "Lighters or Lighter refills." The Federal Register staff has been advised of this error and the 1993 edition of the Code of Federal Regulations will reflect the corrected entry. Because the final rule issued by RSPA amended the entry to show the descriptive phrase in italics, it is not a violation of the HMR to omit this phrase when using "Lighters" or "Lighter refills."
